Instead it should set focus to the out of focus window when selecting it in
the task bar.

uh, that's the way it works here. A double click will minimize it, (first
click gets the focus, second click minimizes). Or clicking on a task bar
button for the window that is in focus will minimize it. But clicking on a
task bar button for a window that is not in focus will simply change the
focus. This is the same behaviour as Windows XP.
