The OP asks for an image of a CD. He doesn't mention, but he can have a
license, and have lost or scratched his CD, or even never have had a CD,
because he bought his computer with a licensed windows preinstalled without
CD. In this case (if he has a license), AFAIK it's legal here in Europe to
get a copy of the CD elsewhere. MS doesn't provide W98 CD's anymore, but
that doesn't mean your license is void when you lost your CD.

others -- the Everest tool he posted I already downloaded and am enjoying
within 98 Second Edition

So, how close are we really now to George Orwell's 1984 in 2008 with security
video cameras around, digital passports, new driver licenses, etc. How much
freedom will we give up as Americans for security or will we trust in a
higher power for true internal safety rather than a fascade of external
security. As you can see, both are needed and important but the true
strength and rock comes from within and not from without. Riddle this and
Riddle that mind you all.

Why doesn't the op just contact Microsoft -- they have always been helpful to
me and still are very helpful to me although I have points of disagreement
with them and agree with Chris Quirke's mvp's stance on the issue of things
to do with external security and internal safety. Heck, if the op wants a
free os then why not just go with Ubuntu Linux and Mozilla Firefox which are
both free and legal. In addition, perhaps the op has some friends who no
longer use Windows 98 Second Edition and have a cd that they will give to him
and transfer the license and cd to him and thus provide op with needed
solution. <him is just a guess and if it is a her then kindly respond so we
can all clear matters up and not be under a Blue Cloud of Confusion>

Exactly, Ebay last time I checked was around $75 up from $50 for a full
retail copy of Windows 98 Second Edition. I guess 98 Second Edition is
becomming popular again what with Dan K's research and DNS Pollution
everywhere.

But it *is* in contravention of the EULA, even in Europe, to make unlawful
copies and distribute them. I didn't say the OP would necessarily be
committing a crime by using such a copy. My point was that the legitimate
owner would be doing so by providing the copy. The act of distributing an
illicit copy of the software is called "piracy". I doubt even Europe managed
to ditch that part of the EULA.

That is the crime that I was speaking of, which crime the OP is
*soliciting*, which, at least in the US, is itself a crime.

I thought that anyone could borrow or get a copy of a Win98 cd from anyone
as long as they their own legal product key.
Is that not correct? Isn't it the product key that is covered by EULA?

Nope. Regardless of "accepted practices" the EULA generally limits what a
person may make copies of *for_their_own_use* and how many, as backups and
not for any other purpose. Depending on the version of the installation
media, it may be used to install multiple machines under some Volume
Licensing or Multiple Activation licensing scheme. And no, you aren't just
buying a license with the media to fulfill it, you are buying the entire
package, a copy of the software and license, as a unit, and that unit is
what's covered by the EULA.

Gary should know better than to be sarcastic in this environment. He is no
doubt, like me, getting a bit 'long in the tooth' and may sometimes forget
that many folk who come here (to what they *percieve* to be Microsoft help
sites) do so when they have (to them) a major disaster happening in their
lives.

From reading many posts, in many groups, I'm quite sure that most 'new'
posters will have little or no clue as to how they 'should' conduct their
enquiries.

Experienced folk (MVP's in particular) should not, in my opinion, take
advantage of the ignorance of those posting for the first time.

I'm all for a little humour ......... but not at the expense of the young
and/or naive.

Gary is what they call a cyber bully. He delights in getting people
pissed off and does so repeatedly in this and other newsgroups. He
apparently achieves some sort of orgasm from attacking others online.
Even if he does know the answer, before he replies, he will belittle
the person he is responding to, to make himself look like a "big man".
In real life he's most likely a miserable loser who has no friends and
no life, so he trolls the newsgroups, as a cyber bully, to make
himself feel important.

PS: I don't think anyone would bother you if you borrowed a Win98Se cd from
another person and used your own key, but I may be wrong. I really can't
understand why making as many Win98SE cds as you want is not allowed as long
as the 'key' is not provided. Perhaps the reason is that there are 'key'
generators out there.

The uneducated OP learned that this is not the place to solicit piracy.
That's all I care about. And maybe to think things through before posting
such a stupid request. If he didn't know it was a stupid request, he needed
to be taught so.

Again, there is absolutely nothing wrong with sarcasm when it gets the point
across. It's not as if I insulted him (except, I suppose, by renaming him,
but even that was in the same spirit -- get his attention.) We're getting a
LOT of babies using Win98 these days, and they grew up, for the most part,
learning lots of illegal computer activities and think nothing of it. If
he's going to be stupid from the outset, he's going to get whacked with the
cluestick. Maybe it will keep him out of worse situations in the future,
when he grows up a few ore years and see all his friends doing other,
equally safe but equally illegal things. Maybe keep him out of jail..

Lastly, if you'll read the entire thread, a lot was explained about piracy
and if the OP actually bothered to read any of the replies, he's learned.
About piracy, about sarcasm about humor, you name it. Otherwise, that's his
loss.

Nobody does care. We're just talking about technicalities, here. And you
don't need to use your own number, you can use any one that will work.
Microsoft does not keep track of Win98 installations and couldn't care less
about them anymore. However, it *is* illegal, in contravention of the legal
document called the EULA, to "borrow" someone else's disk, or give someone
else a copy. It's a question of personal morals more than anything else. The
fact that you're never likely to face any consequences doesn't make it OK in
any way, shape or form.

Heck, I often recommend borrowing a friend's CD if yours is lost, but only
after making sure you don't already have what you need, and not for a clean
install, only as a source of installation files for installing hardware,
reinstalling components, etc..
