Windows Vista OEM

I posted the below in XP's help_and_support forum but I don't think that
forum is watched as much as this vista one is. The core question can be
answered as if I were doing this with a vista product.

I want to purchase XP Pro w/ SP2 from someone on eBay. They claim it is
"Brand New! Genuine from Microsoft! w/ TECH Support"

The only thing is it is an OEM version.

I've never bought an operating system by it's self without being
preinstalled before. Will this OEM version work for me? What are the
limitations on OEM versions?

I am replacing my current XP Pro operating system with a new one because I
locked the system up by playing with the security policy. Yea, dumb but I
was learning and got carried away.

The only Tech support with OEM is when you buy it pre-installed from someone
like Dell, etc; and THEY supply the support.

Mcrosoft does NOT supply Tech Support for OEM disks; and never has.

The diff between OEM and Retail is that OEM is tied to the one computer
until tht computer dies!

eBay is OK for some software; but not from private individuals.

Cllearly, the sale you mention is a lie!

The differences between 'OEM' and 'retail' versions is that the OEM version
is locked to the first computer it is installed on and cannot be moved to
another computer. Microsoft does not provide 'official' technical support
for OEM versions, you can only get technical support from the seller of the
OEM version. OEM versions can be 'upgraded' with a Retail version, but
cannot be 'upgraded' with a diffferent OEM version.

If you intend to install this on just one system and are comfortable finding
support, such as these newsgroups, then by all means buy the OEM version. It
will save you a lot of money. Make sure that the seller is legitimate and
provides the 'Certificate of authenticity' (COA) sticker.

The microsoft.public.windowsxp.general group is a good place to ask
questions about XP. Frank rarely stalks anyone there except me but
that's because he thinks I'm a sheep ;-) That said, I would be careful
about the seller of this OEM and would ask is it generic or branded. If
it's branded, it definitely won't work. If it's generic and the seller
has installed it, it's against the EULA for him or her to sell it unless
they also sell the computer.

I'd hesitate to buy from someone that mis-represents what the OEM version
is. I would look at buying from newegg (or similar).

50% of the software offered for sale on auction web sites is
actually misrepresented, counterfeit and thus useless!

of my head. Carey, your info is coming from where? Keep in mind studies
can be misleading but we can make up our own mind on them.

There is feedback on the seller that one can read and decide if the software
is worth purchasing.

In tests conducted by Microsoft of 115 copies of physical media purchased on eBay,
39 percent were found to be counterfeit, and another 12 percent contained software
that was either counterfeit or had been tampered with. Overall, the study found, the
chances of purchasing genuine, legally licensed Microsoft software on eBay is less than 50 percent.

This is a FUD campaign. E-bay is a buyer beware operation. The attraction
is for good buys. You must use the system features to your benefit to
reduce the odds of getting burnt. I bought at least 20 copies of XP
upgrades and never had a bad transaction. You have to be careful. If you
don't know the system, then and only then I would not recommend dealing.

It's called "user experience".

I guarantee you that those who work in IT never purchase anything from
eBay.

Carey is right. NEVER purchase software on eBay!!! It's a good way
to waste your time and money.

Of course, pirates LOVE eBay, since they can actually sell their
pirated goods for a higher price than the Russians or Chinese.

will not purchase any OEM products; especially from eBay.

Also, I was once told that over 60% of all statistics are inaccurate. Figure
that one out!

Amazon, on the other hand, guarantees the genuineness of the sales of
many software items from third-parties, including Microsoft.

"F.U.D." stands for "Fear, Uncertainty, and Doubt". Even eBay uses
this when they say "Buyer beware!"

Of course, some will love eBay, and some will love Microsoft.
Personally, I am of the opinion that few buyers who go to eBay know
what they are getting into.

Microsoft's campaign should properly be defined as a "Trust,
Certainty, and Faith" campaign, since that is what they offer their
customers when they publish such studies.

You can't make the results go away by simply SAYING the results are
invalid because they were commissioned by Microsoft. You know this,
and I know it. You have to PROVE your statements.

But there is more than enough testimony by folks who have only been
BURNT on eBay to prove the results

Thank God that I've never made that mistake before, nor do I plan on
it. If I can't afford what I want from a legitimate seller, I am not
the type to try to get it from an illegitimate seller. In which case,
I prefer to WAIT till I can afford it, then purchase it from a
legitimate seller.

Windows from them.

I have been thinking of this issue for a while. Not only for Microsoft but
for any software.

Any hardware, appliance, DVD, cd, vhs, furniture, house, car, etc. we can
buy/sell/trade to anyone but not software. Why is it that most digital
products with licenses cant be yard saled away like ma's old sewing machine?
What happened to the 9/10 rule? My car has a title, license if you will, and
I can sell it to anyone. My autographed babe ruth card has a certificate of
authenticity, license if you will, and I can sell it.

Of course, that depends on who funded the study, who published the study,
and who quoted the study. :))

license. When you negotiate a contract and accept it, you agree to the
terms. Implied in the terms are that they are legal...that's all. You can
put anything you want in the terms. Some terms allow for you to sell and
transfer the license. If there is a specific clause in the contract and you
consumate it, you then must comply. It's that simple. IOW if you don't
like the terms, walk away.
